ZPO to Governor of Nagaland

The undersigned would like to submit some few pertinent points which have been confronting the welfare of the public in our Peren District. It is learnt that inauguration of New Peren DC office at New Peren Headquarters is tentatively fixed on 11-12-2014 (News item as gathered from Eastern Mirror issue of November 26, 2014 enclosed for read reference as Annexure-1). In this regard, we would like to apprise the following facts for consideration and necessary action thereof:1. A Public Interest Litigation filed by the Zeliang People’s Organisation, Nagaland with regard to the matter of New Peren DC Headquarters is still laying pending disposal before the Hon’ble Gauhati High Court Kohima Bench. It is of the fact that the case should be settled first before the inauguration in order to avoid discord which might lead to the extent of disruption of social harmony.
2. It is of the fact that basic infrastructural facilities like water, electricity, telephone or internet connection, staff quarters, road and more than 30(thirty) departmental office facilities are yet to be established and constructed.
3. In view of the aforesaid circumstances, the Zeliang People’s Organisation, Nagaland filed a PIL before the Hon’ble Gauhati High Court Kohima Bench admitted vide PIL No. 56/2012 in which the Hon’ble Court disposed the petition by directing the Chief Secretary to the Government of Nagaland to visit the new site and ensure that before shifting the District Headquarters minimum infrastructure in available to his satisfaction, till such infrastructure become available shifting cannot be implemented.
4. However, the then Chief Secretary to the Government of Nagaland never visited the spot for ground verification but submitted a report contrary to the fact with misleading contents which were far from truth. As such, the Government of Nagaland notified to shift the entire office on October 28, 2013 and which led the Zeliang People’s Organisation, Nagaland to impose a lightning bandh against the decision for an ill-timed shifting of Peren District Headquarter (Newspaper clippings enclosed for your ready reference as Annexure-2(i)-2(vii).
5. In any event, the intention and forceful action of the government as experienced lately is totally against the wish and welfare of the general public. More so, it is crystal clear and safe to conclude without doubt that the motive of forceful shifting is only for the interest of few self centred individuals having place in top political bastion for exercise of brute authority which is a clear violation of basic fundamental rights of the constitution.
6. The Zeliang People’s Organisation, Nagaland is concerned for peace and tranquillity in spite of serious threats from political groups and chose to never confront through physical force while pursuing to protect the rights of its people as enshrined in the law of the land and for the very reason another PIL was filed again before the Hon’ble Gauhati High Court Kohima Bench admitted vide PIL No.1(K)2013 for want of legal justice and transparency so as to ensure and maintain harmony amongst the people. Subsequently, hearing the petition, a Committee was constituted by the Hon’ble Court for verification comprising the Home Commissioner, Government of Nagaland and one Advocate from the Bar Association, Gauhati High Court Kohima Bench and hearing of which matter is fixed on 4-12-2014 (Copy of Affidavit as Annexure-3).
Thus, keeping in view the above facts, it is pertinent to mention that inauguration of the office Complex of Deputy Commissioner Peren at the New Peren District Headquarters at this juncture is not viable. It is deeply felt, first of all that the minimum basic requirements of the employees are in place for the smooth and speedy delivery of service to the general public before contemplating on the idea of inauguration. It is also imperative to analyse that no inauguration is initiated upon any infrastructure before the completion to avoid occurrence of unprecedented complications.
Therefore, considering the ground reality at hand, it is our humble prayer that a better sense should prevail upon the authorities concerned and put on hold the inauguration of office Complex of Deputy Commissioner Peren at the New Peren District Headquarters at this juncture for the greater interest of the general public.
