- The Supreme Court in its judgment has directed the beneficiary States/UTs to conduct it's own exam except the state/ut sitting for All India Pre Medical Test (AIPMT). Thus, there's nothing as direction to follow MCI rules as insisted by Technical Department.
- If at all, the state wants to follow Medical Council of India (MCI) guidelines, the Department has to implement it strictly by following points
(a) MCI has not given any authority to any states to conduct an Exam by the State Board of Education (e.g. NBSE in our state). So the Exam should be conducted by the Central Board of School Education (CBSE).
(b) The MCI has also nothing said about setting up Common Selection Board (CSB) but the Nagaland state did headed by Parliamentary Secretary, Technical Education. So this body is an unauthorized.
(c) If the Department has selected the candidates based on MCI than who gave them to give 15% reservations to the BTs of Nagaland when there's nothing as such in the same rules? This is totally against the MCI rules.
(d) according to MCI guidelines, students need to get 40% in 10+2 exam in PCB (Physic, Chemistry and Biology).
- As directed the Nagaland state has also conducted its own exam known as Nagaland State Entrance Exam II by its own framed rules.
- Since the state conducted its own rules MCI guidelines has nothing to do with the NSEE II exam.
- In state rules, there's nothing as such mentioned 40% cut off mark that require by the candidates but they have only spelled out that "required minimum qualifying mark" so what is mean by "minimum" for them? According to this clause of the state rules, any candidates who appeared/ sit for NSEE II exam 2016 is qualified to study MBBS & BDS courses.
- Since state rules is standing, we can't take MCI guidelines and we can't allow two rules in one exam to enforce.
- There's a reservation for Backward Tribes however the cut off mark is same for both General and BTs which shows that in reality the reservation has no meaning.
- As per the MCI rules it has empowered the state with a DISCRETION power to lower down the minimum mark in consultation with the Medical Council of India (MCI), if the maximum number/s of the respective category couldn't reach the minimum qualifying marks.
(9) The ENCSU also wants to let the World aware of 2014 scenario, When there wasn't State Level Exam but only AIPMT, so unfortunately only 1 Naga could reach the so called 40% cut off mark so what the government did, they conducted another exam to fill the unfilled seats in the form of Nagaland State Pre Medical Test (NSPMT) but here too only 22 candidates could reach the the required numbers. Again to fill the remaining 20 plus vacant seats, the government and department has used another mechanism by compiling the marks of AIPMT & NSPMT and send the Students to study the MBBS & BDS courses. So why not the same mechanism be applied when the candidates from BTs couldn't reach the cut off mark? They can do for others but not for people who had enough of discrimination, deprivation and struggling to reach the par with rest of the society?
(10) It is also surprised to see an arrangement of NSEE II Results. The Common Selection Board (CSB) had put the Students who secured more marks in Backward/ reserved category whereas the Students who secured less mark are in merit list. ENCSU therefore appeal the general public to analyse the results carefully and judge accordingly.
(11) Therefore, we humbly appeal all not to pull the issue in Tribal line or shouldn't take it individually because what we are doing is for future. Manipulation and deprivation has amounted Corruption in our system. Whatever situation comes, the ENCSU will not compromise with our stand until 4 missing seats are given back.
With the above cited reason/s, the ENCSU is being fighting for justice because above points has clearly show whether the Department has done justice in the selection.
Therefore, the ENCSU once again appealed the general public not to misjudged the stands of the ENCSU. And the Union also ask any individual having doubt on our stands to come forward and clarify the confusion.
