Organisations seek amendment in NPSC rules, induction of non-SCS into IAS

DIMAPUR — In a joint statement to the chief secretary of Nagaland, four organisations stated that the Regulation of the Nagaland Public Service Commission (NPSC), 2008, Part II, pertaining to the composition and conditions of the service of commission, denies the ‘other services of the state’ to be a member in the apex state public service commission.

The four organisations—the Nagaland State Services Employees’ Association (CANSSEA), the Federation of Nagaland Engineering Service Associations (FONSESA), the Nagaland Secretariat Service Association (NSSA), and the Nagaland Finance and Accounts Service Association (NF&ASA)—have requested that the rules be modified or amended as soon as possible.

According to the joint statement, Article 318 of the Indian Constitution does not specifically make any condition, mention, or lay down any norms or conditions that members should be determined from all India services or state civil services only.

They claimed that when it comes to the nomination of members to state public service commissions, states in the country exercise inclusiveness for other state services; however, the regulation made by the Government of Nagaland shows bias.

Appeal for induction of non-SCS into IAS

The four organisations have appealed to the government in a separate memorandum to the chief secretary for the selection of non-state civil servants (SCS) to the Indian Administrative Service (IAS) under the (Appointment by Selection) Regulations 1997 and the IAS (Appointment by Induction) Regulations 2013, which are being kept for non-state civil servants.

They noted that the induction into the IAS cadre through promotion and selection for both state civil service and other services is governed by the same rules of the Indian Administrative Service (Recruitment) Rules, 1954, as seen in Rule 4, Sub-Rule (2) of Rule 8, and Sub-Rule (91) of Rule 9, and added that the rules specify that recruitment cannot exceed 33.3%, or 1/3, of the senior posts under the state government, out of which it mandates persons to be recruited from non-SCS officers, not exceeding 15% exclusively from other services.

It further said that the IAS from other services was to be 2 in 1997, and in 2010, it was to be 4. However, contrary to the provisions laid down in the Regulations, only 3 IAS, instead of 4, are in position as of today, denying the right to multiple efficient, outstanding, and deserving non-SCS officers.

“Therefore, the confederation of the four associations appeal to the Government to protect the rights and interest of Non-SCS officers and commence the recruitment process,” it read.
