Nagaland government adopts MS Act, 2013 during second session of 14th NLA

KOHIMA — The Nagaland Legislative Assembly (NLA) on Monday repealed the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act and adopted the Prohibition of Employment as Manual Scavengers and their Rehabilitation Act, 2013 (MS Act, 2013) on the first day of the second session of the 14th NLA in Kohima.

The NLA monsoon session, which commenced on Monday, will conclude on Thursday with a one day recess on Wednesday.

Chief Minister Neiphiu Rio moved the resolution to repeal the Act which was enacted by the government of Indian in 1993 and introduced ‘The Prohibition of Employment as Manual Scavengers and their rehabilitation Act 2013’, which was adopted through voice vote.

The state government had adopted ‘The Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act 1993’ in 2008 but has become redundant with the enactment of the new Act in 2013, it stated.

As the Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act 1993 was enacted by the Parliament under Article 252 of the Constitution and was adopted by various states, it can be repealed only through the procedure prescribed under Article 252, which requires passing of resolution for the repeal of the Act by the state legislature, it added.
