Dimapur, May 4 (EMN): The Gauhati High Court, Kohima Bench has today closed the petition filed against Merangkong Medemsanger Putu by one Wapongtemjen and 3 others since the village council revoked its decision to allow only the present serving MLA to contest the forthcoming elections scheduled in 2018 and not to allow any other candidates.
An order issued by Justice Michael Zothankhuma dated May 2, said the resolution passed by the village council was in violation of the provision of the Representation of People’s Act 1951 and the fundamental rights as enshrined under the Constitution of India.
It made known that no individual or authority has the right to curtail the fundamental rights of a citizen of India unless the same is a reasonable lawful restriction.
However since the village council had revoked the earlier resolution, the case had become 'infractuous' and no longer required to keep pending and so the petition was closed.
