Kohima-Dimapur 4-lane project: NHIDCL opts for SLP against High Court ruling

KOHIMA — The National Highways and Infrastructure Development Corporation Limited (NHIDCL) has expressed its preference for Special Leave Petition (SLP) against the order of the Gauhati High Court, Kohima Bench, on March 31 this year, in connection with the package III four-lane road along the National Highway-2 between Kohima and Dimapur.

Owing to this development, the matter is likely to come up before the Supreme Court on May 1, stated the HC order issued on April 26.

It said the court was apprised of the respondent No.8 — M/S Ramky-ECI (JV) Hyderabad – not concluding the works under packages I and II till date despite giving assurance to complete the same.

“Nobody has appeared on behalf of such respondent for last few days of hearing. Thus, we hereby direct that the Managing Director of respondent No.8, M/s Ramky-ECI (JV) shall be intimated through email to remain personally present in the Court on the next date of hearing,” read the order.

Maintaining that the contract issued to the Oasis Techno Construction Ltd. has been cancelled, its name should be deleted from the array of the parties and there should be no requirement to hear from the respondent in further proceedings of the PIL, the court said.

It went on to inform that the ‘re-notify on 09.05.2023 would be to be taken up at 1-15 pm’.

The court had earlier stated in an order that package III of the 4-lane National Highway-2 should be “completed by awarding the work to the Joint Venture Bid of M/s Vilelie Khamo & Sons and M/s Chabou & Co.” “The contractors shall complete the road within the stipulated period in terms of the contract,” it added.  NHIDCL
