High Court makes conditional pre-arrest bail of Naga Club officials absolute

KOHIMA— The Kohima Bench of Gauhati High Court has made the conditional interim pre-arrest bail previously granted to the officials the Naga Club “absolute”.

Hearing the matter, in regard to the FIR filed by the Naga Students’ Federation (NSF), on Thursday, Justice Kakheto Sema, said that after hearing both the parties and on perusal of the relevant records, the court was inclined to make the order dated June 6, granting interim pre-arrest bail to the applicant, “absolute” on the same term and conditions as incorporated in the same order.

The case diary of the investigating officer, which was produced by the public prosecutor before the court, stated that the “arrest (of the applicant) was not necessitated.” Based on this, the applicant was allowed to leave with a request to cooperate with the police investigation, Sema added.

Counsel for the applicant also submitted that the applicant has appeared before the investigating officer and has been cooperating with all conditions as directed by the court.

The learned counsel further placed before the court the letter of the NSF (complainant in the criminal case) addressed to the chief judicial magistrate, Kohima, about the withdrawing of the FIR filed on May 27, it added. Accordingly, the application was disposed of.

The court, in its last order, ruled that the offence charged against the officials of the Naga Club involved in the NSF office demolition was not heinous in nature. It then granted absolute pre-arrest bail to the applicants with terms and conditions.
