Health dept. enforces online drug licencing, warns against illegal advertising

DIMAPUR — The Department of Health and Family Welfare (DoH&FW) informed that, effective April 1, 2024, all drug licencing processes will be conducted exclusively through the online portal. Therefore, no offline or physical applications will be accepted or entertained.

Further, all licensees are informed that renewal, retention, and all other post-approval changes shall be processed exclusively through the online platform, as reported by DIPR.

All currently operating licenced retailers and wholesalers have been instructed to register their firm or business on the provided portal within three months from the date of the notice. In this regard, necessary information and assistance can be obtained from district drug control officers at the respective CMO offices.

The portal mentioned is statedrugs.gov.in, and for assistance, individuals can contact the helpline at 7629875392.

The report mentioned that Section 7 of the Drugs and Magic Remedies (Objectionable Advertisement) Act, 1954, prohibits any involvement in publishing advertisements that suggest or promote the use of drugs for specific purposes.

These purposes include inducing miscarriage in women, preventing conception, enhancing sexual pleasure, correcting menstrual disorders, and diagnosing or treating various conditions such as appendicitis, hydrocele, arteriosclerosis, hysteria, blindness, and infantile paralysis, among others.

Additionally, Section 7 of the mentioned Act includes penal provisions. Upon conviction, individuals may face imprisonment for up to six months, a fine, or both. For subsequent convictions, the punishment may include imprisonment for up to one year, a fine, or both.

All print media, publishers, advertisement agencies, and social media users have been advised to refrain from publishing, promoting, or telecasting drug or medicine products that contravene the provisions of the Act, along with its associated rules.

The department emphasised that strict legal action will be taken against any individuals or entities found to be in violation of these regulations.
