Father gets life for killing own 3 children

EMN Dimapur, December 18 The District Sessions Court Dimapur today has passed a life imprisonment to accused Hoilyunging for committing triple murder to his own 3 siblings Rampauchilung 13, Maheinglung 10, and youngest daughter Ingausilie 8, who were killed with machete (dao) during the night on April 6, 2009 while the innocent victims were sound asleep. The accused father took the plea of being drunk and unsoundness of mind while committing the act, but the learned sessions judge observed that when no one has forced the accused to get drunk nor when nothing insanity was adduced by evidence on the part of the accused person, the plea of insanity/unsoundness of mind in absence of evidence will not make any exception to the accused and the accused deserves to be punished for his guilt for committing triple murder under section 302 of Indian Penal Code. Public Prosecutor, H.Kughashe Swu in a statement said, “Session‘s Court in its own judgment has observe that base on the statements of the prosecution witnesses and the evidence and documents place on record I am not inclined to hold that accused at the time of killing his own children’s was unaware of his action but being guilt and ashamed, accused has to blame alcohol drinking problem thereby question of sanity plea was taken. And in any view of the matter I hold that the prosecution is able to proof triple murder against accused beyond all reasonable doubt and accordingly I hold the accused guilty as charge u/s 302 of IPC.” Considering the loss of three lives in one family alone, depriving minors a longer life and being victims of crime perpetuated by the accused, and the mother being alive who was tortured mentally and the accused father being sentenced to life rigorous imprisonment, the judgment also recommended for payment of compensation to the victims’ mother by the State government under section 357- A of Cr.PC as per notified Nagaland Compensation Scheme 2012.
