14th NLA session: Kenye moves resolution to repeal Nagaland Municipal Act 2001

KOHIMA: Minister of Power and Parliamentary Affairs KG Kenye on Tuesday moved the House for introduction, consideration and adoption of a resolution to repeal the Nagaland Municipal Act, 2001, at the ongoing first session of the 14th Nagaland Legislative Assembly.

The matter was taken up on urgent public importance, wherein Kenye supported by legislator Namri Nchang and Advisor Kropol Vitsu, initiated the discussion on the Urban Local Bodies issue.

However, it has not been adopted till the time of filing this report.

The move came amid demand by several civil society organisations that certain portion — tax on land and building — in the Nagaland Municipal Act 2001 be amended, alleging that it infringes Article 371 (A) of the Indian Constitution, and that the mention about 33% reservation for women be replaced by nominations with voting rights, before holding the election.

The state election commission had earlier announced that the election to three municipal councils and 36 town councils would be conducted in the state on May 16, several years after the attempt in 2017 ended in violence, leading to death of two people and damage of properties.
