What is Citizenship Amendment Bill 2016? Why We All Need to Worry?

The unrelenting influx of illegal migrants from Bangladesh into Assam and the consequent perceptible change in the demographic pattern of the whole North-east india has been a matter of Grave concern . It poses a serious threat both to the identity of the indigenous people and to our National Security. It threatens to reduce the Tribal indigenous Citizens to a minority in their own State , as happened to Tripura And SikKim. Illegal migration has generated a host of Destabilising Political, Social, economic, ethnic And communal tensions. Politically, the Bangladeshi migrants are in a position to influence the results of the election in a large number of Constituencies in North-east (about 32% of the Constituencies in Assam ). Economically increased pressure on Land, resulting in depletion of Forest wealth, under cutting of ways of unskilled Jops, forcible occupation of government land by the migrants and a host of other such issues, generates a ripple effect in entire North -East.

Who is an illegal immigrants in India?
According to the Citizenship Act 1955 , and illegal immigrants is defined as a person who enters india without a valid Password, or stays in the country after expiring of the visa permit. Also the immigrants Who uses false documents for the immigration process.

What are the Guidelines to become an Indian citizenship ?
Citizenship is granted to an individual by the government of the country when he/she complies with the legal- Formalities so it’s like a judicial Concept. In India, citizenship Act 1955 describes Five (5) ways of acquiring Citizenship:-

1. By Birth
2. By Descent
3. By Registration
4. By Naturalisation And
5. By incorporation of the Territory

What is the Citizenship Act 1955 ?
The Citizenship Act 1955 underlines ….
1. Under Article _9 of the Constitution, a person who voluntarily acquired citizenship of any other country is no longer an Indian citizen.
2. Citizenship by descent. .. person born outside india on or before January 26, 1950, but before December 10,1992 are citizen of india by descent if their Father was a citizen of india at the time of their Birth.
3. From December 3, 2004 , onwards persons born outside of india shall not be considered citizen of india Unless this birth is registered at Indian consulate within one (1) year of the date of birth.
4. In section 8 of the Citizenship Act 1955, if an adult makes a declaration of renunciation of india Citizenship , he loses india Citizenship.

Now, what is Citizenship Amendment Act of 2016 ?
The Controversial Citizenship Amendment Act was proposed in Lok Sabha on July 19, 2016.
On January 2019, the Citizenship Amendment Act 2016 was passed in lok sabha By Amending the Citizenship Amendment Act 1955 , there by Legalising illegal migrants From certain Minority communities coming from Afghanistan, Bangladesh and Pakistan to become a legal Indian Citizens. In short, illegal migrants belonging to the Hindu,Sikhs, Buddhist, Jains, Parsi or Christian religious communities from Afghanistan, Bangladesh and Pakistan would not be imprisoned or deported.

Moreover, these citizen’s gain permanent citizenship after Six (6) years of residence in india instead of 11 years as mentioned in the Citizenship Act 1955 .

Why we all Need to worry ??
While on one hand there is absolute lack on the part of the central And state Government to deport the Foreign nationals , on the other hand, the centre is contemplating to amend the Citizenship Act to give citizenship to a large number of illegal immigrants Belonging to a particular religion( Hindu). The objective of BJP Government at centre is Simple ..i..e to overshadow the minority indigenous Citizens By Hindu illegal immigrants. The move is well guided to achieve the Ideology of V. D Savarkar ( Hindu Rashtra) .

If the proposed Amendment in the Citizenship Act is not withdrawn immediately, it will be a death knell for the indigenous people of whole North -East. It is irony that when the people of the states are demanding detection And deportation of illegal migrants, the BJP Government rather than helping the North Eastern to eradicate Immigrants is Legalising them there by Considering

North East Asia dumbing ground for Hindu illegal Migrants for vote bank and to achieve the V. D Savarkar Dream of making india a Hindu Country.

Some eminent Danger/ Consequences of this infamous Citizenship Amendment Act 2016 that awaits us all :—-
1. Social consequences
A. Crisis of identity –
The influence of immigrants created a crisis of identity among the indigenous Assamese . The immigrants there by floated into Nagaland. ..All claiming to be Assamese. Our cultural survival will be in jeopardy. Assamese found that though , the migrants had settled in Assam, most of them failed to identify themselves with the mainstream. The recent Bodo-Muslim violence in the BTAD has its root on the issue of illegalmigration.

B. Environmental Degradation –
Large areas of Forest land were encroached upon by the immigrants for settlement and cultivation.

C. Difficult to identify the illegal migrants –
Due to the similar language spoken by illegal immigrants from Bangladesh and the indigenous Bengali speaking Muslim of Assam, it become difficult to identify and deport the illegal immigrants from Assam and other north eastern states.

D. Community tension –
The commission on integration and cohesion found that Tension usually exist with the presence of high levels of migration combine with other forms of social exclusion like , poverty , poor housing, health facilities etc. The incidents that is happening in our state involving the Non-locol in cases like ….Rape, kidnapping, extortion, robeery etc speaks Volume of community tension that awaits .

2. Economic Consequences
A. Increases financial Burden –
Immigration has increased pressure on the part of state government, as the government has to increase the expenditure on education and health. The already deficit ridden economy and poor state like Nagaland cannot expect the burden of finance for Immigrants.

B. Displacing Native workers –
There is a fear particularly during a recession that immigrants take Jops which otherwisebe taken by locol people , in particular place and circumstances . There can be competitionand conflicts .

C. Decreasing Wage level with the increase of population. –
Illegal immigrants every year have been adding a good numberof people in Nagaland, it is one of the main reason of population explosion. Due this factor there is possibility of decreasing Wage level of our Local labours.

3. Political Consequences
A. Agitation and social unrest is eminent-
The failure of government to respond the issues of illegal immigrants led to agitation by the Assamese under the leadership of All Assam Gana Sangram Parishad (AAGSP) and All Assam Student’s Union ( AASU) . Assam is Witnessing governmental instability, sustained Civil Disobedience campaign And worst cases of ethnic violence. Assam AccorD was the result of this agitation. Nagaland awaits Such Agitation and social unrestof grave danger ,if government fails to check and secure the illegal migrants Invasion through Citizenship Amendment Act 2016.

B. Illegal Voters-
Most of the Bangladeshiillegal immigrants have got their names enlisted in the
Voters list illegally ….of course with the help of their beloved Naga dada, kokai, ama, baba, didi etc etc,thereby claiming themselves a genuine citizens of the state. The immigrants population act As a vote bank for certain political parties or candidates. Dimapur Is the best example of this activity. It is only a matter of time, when an illegal immigrants will become an MLAS or Chief Minister in Nagaland representing immigrants.

C. Issue of Terrorism –
This word sounds quite Alien/foreign to us But Pakistan ISI has been active in Bangladesh Supporting militants movement in Assam (Lt Gen S.K. SINHA 1998) and North East militants Groups . It is alleged that among the illegal migrants there are also militants who enters into Assam to carry out terrorist activities . If illegal immigrants are given free passage to
Our land according to New citizenship Amendments Act 2016 . Dimapur Is no for from before a Hotime bed for Terrorism activities.
“ illegal immigrants hurts- Naga Workers (business ), Burdens Naga Taxpayer, and places enormous strain on Local Schools, Hospitals, …..Some people Call it And invasion”.
